DIY Islam versus Shafi'i Fiqh

I came across this the other day at the at-Talib blog and think it's worth reading, especially for those who believe it's okay to make off-the-cuff judgments when they come across an (allegedly) authentic narration that seems to contradict the rulings of their madhhab:
Invalidating Wudu by Touching a Member of the Opposite Gender
Answered by Shaykh Taha Karaan
Please realize that this in no way is meant to defame the good name of Dr. Zakir Naik, since it's not even clear if this is truly his view. Rather, it's the slipshod methodology of so-called "Do-It-Yourself Islam" that we're trying to expose here, not the (alleged) opinion of any one individual.

Those wanting more information on Shafi'i fiqh (i.e. jurisprudence), I highly recommended reading Reliance of the Traveller, exploring the Shafi'i Fiqh section at the Seeking Ilm blog and taking some of the courses ([1][2][3][4]) at SunniPath.com.

For more details on this particular fiqh issue, read The Proofs that Touching A Woman Breaks Wudhu' at Seeking Ilm. Likewise, Sidi Abul Layth's Responding to the Question of Why I Chose the Shafi’i School was just recently posted, so check that out as well.

Deen on...

Assalamu-alaikum,
dear mere muslim - the link you forwarded to Shaykh Taha Karan's article was a very refreshing read because i dont think there was anything in it Sunni Muslims could disagree on. He focused on:

1. The necessity of akhlaq towards the early senior scholars who all endeavoured to understand the complexities of Shari'ah (Qur'an & Sunnah)
2. The praiseworthy nature of wanting to follow the sunnah
3. the necessity of being knowledgeable about an imams'/madhabs' reason for abandoning a certain hadith or understanding its context differently
4. Acknowledging the tremendous seniority of the early fuqaha (esp. the 4 mujtahids) and not dismissing their rulings brashly on the basis of some ahadith without knowing what those imams made of these ahadith

5. the point that madhabs exist only to facilitate understanding of the Qur'an/sunnah as the Messenger (alayhissalam) intended - not to imprison its followers & that departure from a madhab WAS possible if certian conditions were met (namely that it be a sunnah following exercise not a desire following one & that another sunni mujtahid mutlaq must have held that view)

So you would label me, in fact you have done so already, a self-taught do-it-yourself pseudo-salafi wahhabi innovator, and in the words of your friend Abu Layth at seekingilm.com, 'all pseudo-salafis are evil and a scourge upon the earth' -and yet i could easily have been convinced that i was reading an article form one of the more sensible salafi scholars if i didnt know better. I thought it was an excellent article - very balanced and lacking extremism.

But the author did not, most likely intentionally, allude at all to the dangers of ta'assub amongst some followers of madhabs who seem to lose sight of the
reason madhabs exist.
To conlcude: thankyou for this link.

assalam alaykum, brother

regarding Dr. Zakir Naik, he is a salafi, admires Albani, ok, but he also seems to belong to the extremist near-khwarij fringe, the so-called Caliphate of Yazid movement, which began in Pakistan about 30 years ago amongst hard-line anti-shi'ite salafis.

His calling Yazid 'may God be pleased with him' raised a few eyebrows, and his subsequent clarification did not help. You may have seen the video on YouTube??
